By emergency regulation first promulgated on February 15, 2013, and since then renewed, the New York State Department of Financial Services (DFS) established the Storm Sandy Mediation Program ("Program"). See 11 NYCRR Part 216 (Insurance Regulation 64), Fifteenth Amendment. The Program has provided mediation for more than two years and very few requests for mediation under the Program are still being made. Accordingly, DFS expects to discontinue the Program after August 2, 2015.

June 22, 2015 Filing Deadline

Policyholders with unresolved eligible claims who still wish to mediate those claims, and who have not previously requested mediation, should file a request to mediate on or before June 22, 2015. The Program applies to real and personal property claims, other than those for damage to motor vehicles, which arose between October 26, 2012 and November 15, 2012 in the counties of Bronx, Kings, Nassau, New York, Orange, Queens, Richmond, Rockland, Suffolk or Westchester, including their adjacent waters, that were denied in whole or in part by the insurer or for which the policyholder disputed a settlement offer by their insurer, provided that the difference between the positions of the insurer and the policyholder on the disputed claim is $1,000 or more. Claims made under the National Flood Insurance Program, which is administered by the federal government, are not eligible.

Filing Information

The American Arbitration Association ("AAA") is the organization designated by the Superintendent to provide mediators to mediate claims under the Program. Policyholders wishing to file requests for mediation on or before the June 22, 2015 deadline can find the request form and instructions for filing the form on the AAA's website information page for Storm Sandy New York Insureds/Claimants.
