
If your business was enrolled in Healthy NY as of March 23, 2010, and did not make any subsequent changes to your coverage (other than adding or removing employees or adding prescription drug coverage) and have not reduced the employer contribution amount by greater than 5%, you have the option of continuing your Healthy NY coverage as grandfathered coverage.
Grandfathered coverage will exempt you from certain changes due to Federal Healthcare Reform. Grandfathered Healthy NY small business plans will continue to have a $20 co-payment for preventive services.
Your business may elect to change your grandfathered coverage to non-grandfathered at the time of annual recertification or whenever you experience a premium rate change. It is also important to note that if you remove prescription drug coverage, switch to a High Deductible Health Plan, switch your coverage to another HMO, or reduce your contribution amount by greater than 5%, you will lose grandfathered status.
