CALL FOR SPECIAL REPORT PURSUANT TO SECTION 308, NEW YORK INSURANCE LAW: COMMERCIAL AUTOMOBILE LIABILITY INSURERS COVERING PUBLIC AUTOMOBILE CLASSIFICATIONS

In our effort to ensure that appropriate insurance coverage is available at an affordable price, and to promote the long-term viability of entities providing such coverage, the Department continues to monitor issues and developments affecting public livery insurance in New York. 

To assist us, pursuant to Section 308 of the Insurance Law, your company is required to complete the Voluntary Public Auto Classifications survey.  Your company was chosen because our records indicate that you have participated in past surveys or currently participate in this market.

This survey requests detailed information on the total number of policies and direct premiums written, by category, under all public auto classifications of public commercial auto for the period January 1, 2011 through September 30, 2012.  Information regarding any rate revisions being contemplated or revisions to your current levels of writings in the immediate future is also requested.

Your company’s senior underwriting officer should complete the survey questionnaire, which may be found at the Department’s website http://www.dfs.ny.gov/insurance/datacall/datacal3.htm and submit it to the Department by e-mail or CD-R.  The questionnaire is in Excel format.

Please carefully read the filing instructions in the "Readme" file, and respond to all questions and instructions in the "Report" file.

Your company must respond by e-mail or return the completed CD-R no later than December 10, 2012.

Insurers that provide coverage for this market should be in the final stages of completing their review of the loss experience to determine if any change in their current rates is appropriate.  Pursuant to Article 23 of the Insurance Law, rate filings for public automobiles are subject to the prior approval of the Superintendent.  In order to assure adequate time for the Department to review these rate filings, insurers that intend to change their current rates, and insurers that intend to make an initial filing for the new policy year must submit such filings as soon as possible.
