RE: CALL FOR SPECIAL REPORT PURSUANT TO SECTION 308, NEW YORK INSURANCE LAW: DISPUTED NO-FAULT CLAIMS

The Department continues to monitor issues and developments affecting No-fault claim payments and adjudication of disputes concerning first party benefits. In August of 2005, Assembly Bill 7255 was enacted. The Bill required the purchase of an index number for all filings made in court. The Department wants to determine if this legislation has altered the filing behavior of No-fault applicants.

Pursuant to Section 308 of the Insurance Law, your company is required to furnish this Department with information related to No-fault claims that are presented for resolution either in the courts or through the No-fault arbitration system.

Your company’s senior claims officer should complete the questionnaire, which may be found at the Department’s website (http://www.ins.state.ny.us/nfc308tx.htm) and submit it to the Department by e-mail or diskette.

Please carefully read the filing instructions in the "Readme" file, and respond to all questions in the "Report" file.

Your company must respond by e-mail or return the completed diskette no later than September 29, 2006.
