OGC Opinion No. 07-03-09

The Office of General Counsel issued the following opinion on March 13, 2007, representing the position of the New York State Insurance Department.

Re: Malpractice Insurance

The Department was asked what type of insurance a corporation should purchase to indemnify its physicians, and how much coverage it should obtain.

The Department of Insurance cannot advise as to what type of insurance a business should purchase. It was suggested to the inquirer that he may wish to consult a reputable and trustworthy insurance agent or broker who could assist him in deciding upon an appropriate form of coverage that best suits the needs of the business.
