Submission Instructions for Paid Family Leave (PFL) Benefits Coverage
Insurers must amend the policy forms for PFL coverage effective as of January 1, 2026 to include, as variable, the new construction worker provision included in the 2026 model rider. This change is required to ensure a smooth distribution of the approved policy rider to insureds if/when the Governor signs S. 50/A. 4727 prior to January 1, 2026 with an effective date of January 1, 2026. Use the 2026 Model Rider and the Redline 2026 Model Rider and assign a new unique form number in the lower left hand corner.
Insurers should send the form and rate submission to DFS through SERFF no later than October 2, 2025. Refer to the PFL SERFF Checklist. When making the SERFF submission, use the SUB-TOI for Statutory Family Leave Benefits Coverage.
For ease of review and to expedite the approval process, insurers should provide a redline copy of the changes made to the rider approved for use in 2025 (or 2024 if no new approval was sought for 2025). The redline copy should be attached in the supporting documentation tab in SERFF. Insurers should also include the state tracking number of the approved 2024 or 2025 submission in the general information tab in SERFF.
Insurers should review the previously approved application form for PFL to determine whether a new application form or explanation of variability is necessary.
Insurers issuing a standalone PFL policy should refer to the Redline 2026 Model Rider to determine the appropriate changes for 2026. Insurers may wish to add the changes to the policy by rider or may submit a new 2026 standalone PFL policy. For ease of review and to expedite the approval process, insurers choosing to submit a new 2026 standalone policy should provide a redline copy of the changes made to the form approved for use in 2025 (or 2024 if no new approval was sought for 2025). Insurers must distribute the approved 2026 rider (or standalone PFL policy when applicable) to all policyholders in advance of the January 1, 2026 effective date.
