Excess Lines: Premium Tax Statement

Due Date

The Premium Tax Statement Filing is due annually on March 15th.

If March 15th falls on a Saturday, Sunday, or legal holiday, the due date is the next business day.

Online Filing

Note: As of January 1, 2024, excess line brokers may file "ZERO" premium tax statements online if they meet ALL of the following criteria:

  • No surplus lines business was written in New York for year 2023;
  • No transactions were reported to Excess Line Association of New York (ELANY) for any endorsements/cancellations; and
  • No premium taxes or credits are due for 2023 and prior years.

Important: The above filing option is for ZERO filers only. NON ZERO Filers may only start filing premium tax statements at the end of February 2024, after ELANY's members' report of 2023 is uploaded to the DFS Portal.

DFS Portal Accounts

The statement should be filed via the DFS Portal. To access the DFS Portal, you must have a DFS Portal account. If you do not have a Portal account you will need to create one.

To get started, visit the DFS Portal:

  • Use a supported browser: The latest version plus one previous of Edge, FF, Chrome and Safari, are supported.
  • Disable “Pop-up Blockers” in your browser before using portal applications.
  • Application may be unavailable from 7:30am to 7:45am daily for scheduled maintenance.
  • Applications may not be compatible with cell phones, tablets or other mobile devices.

To File a Statement for Only One Broker Account

  • After logging on, select tab "Ask for Apps"
  • Select "Excess Line - Premium Tax Submission"
  • Enter the Site ID in the field (8 capitalized letters followed by the license number) and hit Submit. You will be sent back to the home page
  • If you don’t have a Site ID, request one via email to [email protected]
  • Select "Excess Line – Premium Tax Submission"
  • Select "View/Edit Draft Statement" next to 2023
  • Start your online tax filing

Note: The Broker Site ID only needs to be entered once for one portal account.

To File a Statement for More Than One Broker Account

Option A (allows you to access the premium tax statement filing by entering one site ID at a time):

  1. After you complete one premium tax statement, do not log off,
  2. Select tab "Ask for Apps"
  3. Select "Excess Line – Premium Tax Submission"
  4. Enter the Site ID in the box and hit "Submit". You will be sent back to the home page
  5. Select "Excess Line – Premium Tax Submission"
  6. Select the license number you requested access for (There will be another license number in the box since you requested access for more than one site ID)
  7. Select "View/Edit Draft Statement" next to 2023
  8. Start your online tax filing
  9. File additional premium tax statements by repeating the steps "2" through "8"

Option B (allows you to enter multiple site IDs before completing premium tax statements):

  1. After you log on, select tab "Ask for Apps"
  2. Select "for Excess Line – Premium Tax Submission"
  3. Enter the Site ID in the box and hit "Submit." You will be prompted back to the home page
  4. Enter additional site IDs, just repeat steps 1 through 3 above
  5. After you enter all the site IDs, select "Excess Line – Premium Tax Submission"
  6. Select the license number of your choice (All license numbers you have requested access for will appear in the box)
  7. Select "View/Edit Draft Statement" next to 2023
  8. Start your online tax filing

Continue to file additional premium tax statements by selecting the tab “My Apps”, then selecting "Excess Line - Premium Tax Submission" and entering another license number.

Supplemental Premium Tax Statements

Excess line brokers must file supplemental premium tax statements online via the DFS Portal. Supplemental premium tax statement can only be filed after the original premium tax statement has been submitted and there is a need for an amendment such as:

  • To correct error/s on the original premium tax statement
  • To report additional transactions
  • To claim credit/refund

Note: The link for the supplemental filing will not appear unless the original premium tax statement was submitted via the DFS Portal.
