Mental Health and Substance Use Disorder Parity Compliance Program Certification
10 NYCRR Subpart 98-4 and 11 NYCRR Part 230 require that companies establish a mental health and substance use disorder parity compliance program and sets forth the requirements of such programs.
The regulation further requires companies to submit a written certification to the Superintendent or Commissioner, as applicable, certifying that the company satisfactorily meets the requirements of the regulation. The certification is required to be submitted by December 31, 2021 and annually thereafter.
- Insurers subject to the regulation must use the Mental Health and Substance Use Disorder Treatment Parity Compliance Program Annual Certification Form (PDF) to meet the certification requirement.
Managed Care Organizations (MCOs) certified pursuant to Public Health Law Article 44 should submit the certification to the Department of Health, for both government and commercial plans. All other insurers should submit the certification to the Department of Financial Services.
