Mental Health and Substance Use Disorder Parity Programs
Compliance Program Annual Certification
10 NYCRR Subpart 98-4 and 11 NYCRR Part 230 require that companies establish a mental health and substance use disorder parity compliance program and sets forth the requirements of such programs. The regulation further requires companies to submit a written Certification to the Superintendent or Commissioner, as applicable, certifying that the company satisfactorily meets the requirements of the regulation. The certification is required to be submitted annually.
- Insurers subject to the regulation must use the Mental Health and Substance Use Disorder Treatment Parity Compliance Program Annual Certification Form (PDF) to meet the certification requirement.
Managed Care Organizations (MCOs) certified pursuant to Public Health Law Article 44 should submit the certification to the Department of Health, for both government and commercial plans. All other insurers should submit the certification to the Department of Financial Services.

Mental Health and Substance Use Disorder Parity Reporting
The following instructions, template and attestation should be used for Mental Health and Substance Use Disorder Parity Reporting as required under New York Insurance Law.
The data reporting requirement applies to individual, group and blanket policies or contracts that provide comprehensive-type coverage, and that are issued by insurers authorized to write accident and health insurance in New York State, corporations organized pursuant to Article 43 of the Insurance Law, and managed care organizations certified pursuant to Article 44 of the Public Health Law.
The legislation requires such insurers to provide the requested information for the preceding two calendar years to the Superintendent of the Department of Financial Services beginning July 1, 2019 and every two years thereafter.
Note: Prepaid Health Services Plans (PHSPs) are required to report data related to products offered in the commercial individual market for the specified reporting periods.
