Re: Call for Special Report Pursuant to Insurance Law Section 308(a)(1): The Incidence of Misrepresentations by Insureds of the Principal Place Where Their Vehicles Are Driven and Garaged

Pursuant to New York Insurance Law Section 308(a)(1), the Department of Financial Services (DFS) hereby instructs each authorized Licensed Property and Casualty Insurers to provide the frequency of misrepresentations by insureds of the principal place where their vehicles are driven and garaged.

By way of background, Insurance Law Section 308(a)(1) states that the superintendent may inquire about any health maintenance organization, life settlement provider or authorized insurer regarding its transaction or condition. Any corporation or person addressed must respond in writing promptly and truthfully. If a response is not provided within a specified timeframe, a civil penalty may be imposed.

For the purpose of this request, DFS is requesting information concerning misrepresentations by New York residents that involve locations within and outside of New York.

The information should be submitted electronically via the DFS Portal using the online form located within the Annual SIU Report Application. Your company’s Special Investigations Unit (SIU) Manager and Executive Officer responsible for the SIU filing, must submit the completed form on or before February 15, 2026.
