Summary of Changes

- Sections I (Scope), II.D.3(b) (Explanation of Unique Features and Markets), II.D.4(c) (Extension of Approval), II.D.4(d) (Extension of Approval), V.C.1(b)(i) (Extension of Approval Filing), V.C.2(a) (Electronic Applications), V.C.2(b) (Electronic Applications), and V.C.2(d) (Electronic Applications) were revised by replacing existing references to “agent” with references to “producer” for clarity.
- Section II.A.4 (Filings Must be Submitted Through the System for Electronic Rates and Forms Filing (“SERFF”)), formerly Filings Must be Submitted Through State Electronic Rate and Forms Filing System (“SERFF”), has been revised for consistency with other posted outlines to correct the acronym to reference the System for Electronic Rates and Forms Filing and the effective date of the regulation.
- Sections II.A.4(b) (Filings Must be Submitted Through the System for Electronic Rates and Forms Filing (“SERFF”)), II.A.4(c) (Exemption from SERFF Submission Requirement), II.C.8 (Circular Letter No. 8 (1999), II.D.1 (Filing Basis), and II.E.1(a) (Readability Certification) were revised to include embedded links to guidance posted on the Department’s website.
- Section II.B.4(d) (Filing of Non-English Versions of Forms) was revised to correct a typo in the statutory citation.
- Section II.D.2(b) (Compliance with Section I.G. of Circular Letter No. 6 (1963)) was revised to indicate that the Department file number should be provided for referenced forms in other submissions.
- Section II.D.3(c) (Explanation of Unique Features and Markets) was added to remind insurers to include in the SERFF Filing Description the information discussed in Circular Letter No. 6 (2023) and the corresponding Filing Guidance. Sections II.D.3(c), II.D.3(d), II.D.3(e), II.D.3(f), and II.D.3(g) were renumbered as II.D.3(d), II.D.3(e), II.D.3(f), II.D.3(g), and II.D.3(h) respectively.
- Section II.D.3(f) (Explanation of Unique Features and Markets), formerly section II.D.3(e), was revised to remind insurers to provide the form number of the conditional receipt or temporary insurance agreement used if payment is accepted at the time of application, including for reinstatement.
- Section II.D.4(d) (Extension of Approval) was revised to clarify situations in which no extension of approval filing would be required.
- Section II.D.6 (Informational Filing) was added to remind insurers of the procedures for submitting informational filings and for consistency with other posted outlines.
- Section II.E.3(a) (Screen Shots) was revised to clarify types of screens that should and should not be included in the screen shots submitted as part of an extension of approval filing.
- Section II.E.4 (Electronic/Telephonic Procedures) was revised to remind insurers that any electronic or telephonic procedure approval corresponds to a specific application form and is not for general use.
- Section II.F (Key References) was expanded for completeness.
- Section III.A.4(a) (Bar Codes and QR Codes), formerly section III.A.4, was revised, consistent with other posted outlines, to reference QR codes and sections III.A.4(b), III.A.4(b)(i), III.A.4(b)(ii), III.A.4(b)(iii), and III.A.4(b)(iv) were added to address adding bar codes or QR codes to previously approved policy forms using an informational filing.
- Section III.D.5 (Indeterminate Premium) was revised to remind insurers that separate indeterminate premium notices must be submitted for approval and to revise language for consistency with other posted outlines.
- Section IV.B.1 (Conditional Receipts/Temporary Insurance Agreements) was revised to remind insurers that a conditional receipt or temporary insurance agreement must be issued if payment is accepted with an application requiring evidence of insurability, including reinstatement applications.
- Sections IV.C. (Fair Credit Reporting Act and MIB Notices) and IV.C.2(d) (MIB Notices) were revised to reference MIB, LLC instead of MIB, Inc.
- Section V.B.1 (Procedures) was revised to clarify situations in which no extension of approval filing would be required.
- Sections V.B.3(a), V.B.3(b), and V.B.3(c) (Scripts Used With Telephone Interviews) were clarified and reorganized in sections V.B.3(a), V.B.3(b), V.B.3(c), and V.B.3(d).
- Section V.C.1(a) (No Filing Required) was revised to clarify situations in which no extension of approval filing would be required.
- Section VII.B.11 (Insurable Interest) was revised to utilize gender-neutral language.
