In New York, it takes an average of more than 150 days to move foreclosed homes from judgment of foreclosure and sale to auction. During that time, even those borrowers who had elected to stay in their homes during the foreclosure process are often forced to vacate, leaving properties to deteriorate. The new law creates a post-foreclosure timeline for returning vacant and abandoned properties back to the market by giving plaintiffs only 90 days from obtaining a judgment of foreclosure to move to auction and, if the plaintiff purchases the property at auction, only an additional 180 days to place the property on the market for sale or other occupancy.
