Re: CALL FOR SPECIAL REPORT PURSUANT TO SECTION 308, NEW YORK INSURANCE LAW: MEDICAL MALPRACTICE INSURANCE NET DIRECT PREMIUMS WRITTEN IN NEW YORK
Dear Company Representative,
Insurance Regulation No. 170 (11 NYCRR 430), promulgated pursuant to Section 5502(c) of the Insurance Law, established the New York Medical Malpractice Insurance Plan (“Plan”) and requires all insurers licensed in New York and writing medical malpractice insurance on a direct basis to be members of the Plan. Eligible health care practitioners and facilities unable to obtain coverage in the voluntary market will be assigned to members of the Plan writing the applicable class of coverage.
In order for us to determine whether your company is required to participate as a member of the Plan, please complete the survey questionnaire, which is posted on this Department’s website (Property Insurers: Data Call - New York Medical Malpractice Insurance Plan | Department of Financial Services). Please carefully read the filing instructions in the "Instructions_MMIP" file, which has been revised and updated for this year, and respond to all questions and instructions in the Excel report file (m308rept.xls). The information in the report file will also be used to determine, among other items, the company’s proportionate voting rights and share of the writings, expenses, servicing allowance, capital charges, management fees and losses of the Plan.
Premiums attributable to the company’s 2025 participation in the Plan, for classifications of business written by the Plan (as indicated in the report format), should be included in this report and should be reported in accordance with the Statement of Statutory Accounting Principles No. 63 for both Annual Statement reporting and for this special report.
