SUBJECT: MANDATORY HOME HEALTH COVERAGE
Subsequent to the enactment of Chapter 647, Laws of 1975, the Insurance Department received many inquiries from insurers concerning interpretation of the legislation. Many questions have been answered by the Department and in order to inform all insurers of the Department's conclusions and, thus, obtain a measure of uniformity in contract language and in the administration of the benefit provision, the following Department determinations are set forth:
1. An insurer must provide all of the home care benefits required by the statute.
2. An insurer may not limit the home care benefits to a fixed dollar amount, but must pay for reasonable charges for the home care services.
3. Hospital indemnity policies, including those which contain surgical riders, are not policies which provide "coverage for in-patient hospital care" and, therefore, are not required to include the mandated home health care benefits.
4. While home care benefits must be provided in addition to in-hospital and skilled nursing facility benefits, the duration of such home care benefits should be limited to the period hospitalization or confinement in a skilled nursing facility would otherwise have been required had home care benefits not been provided.
5. "Medical supplies, drugs and medications prescribed by a physician, and laboratory services by or on behalf of a hospital" must be covered to the same extent and duration that such items would have been provided and covered had the person been hospitalized. This benefit must also be provided if the covered person would have required confinement in a skilled nursing facility.
6. No insurer may limit payment for home health care services to a home health care agency with which the insurer has an agreement.
7. Home health care benefits following hospitalization or confinement in a skilled nursing facility must be provided if continued hospitalization or confinement would otherwise have been required if home care was not provided. Prior hospitalization, however, is not necessary to qualify for home care benefits.
8. Because the home care benefit is now mandated and must be added at the first annual anniversary date after April 1, 1976, to all contracts providing coverage for in-patient hospital care, the reference to the addition of such benefits at subsequent anniversary dates, subject to evidence of insurability, is inapplicable.
9. Home care benefits can be assigned to the provider only if permitted by the provisions of the policy.
10. When a major medical policy includes part of the required home care coverage, the insurer will comply with the statute by making available the remainder of the benefits required by the home health care law. When major medical coverage is superimposed over basic insurance coverage, home health care coverage in the major medical policy may be made excess over home health care coverage in the underlying policy.
11. In the event home care benefits are provided in more than one contract covering the same insured, permissible duplication of benefits provisions included in the contract shall also be applicable to such home care benefits.
12. It is not permissible to include a separate deductible or co-payment provision applicable to the home care benefits if the policy requires the satisfaction of an over-all deductible or co-payment amounts.
13. "Medical supplies" required to be provided as part of the home care benefits means all medical supplies customarily provided by hospitals to registered in-patients.
14. In the Department's previous circular letter relating to home health care coverage, dated April 18, 1973, the Department set forth maximum rate levels for home care benefits. There has been no evidence to support an increase in the maximum rate levels previously established and, accordingly, these maximum rate levels will continue to be applied by the Department in the approval of rates for home care benefits. The following are the maximum rate levels previously set by the Department:
A. Individual Policies of Hospital Insurance.

These rates will be reviewed in the light of developing experience. Rates differing from those set forth above will be allowed only upon presentation of convincing data justifying a departure based on the peculiarities of the form or the market segment involved.
15. To assist insurers in identifying certified home health agencies in New York State, the attached list of such agencies has been furnished the Insurance Department by the Bureau of Community Nursing and Home Health Services, New York State Department of Health.
