RE: REPORTING OF FIRE LOSSES
Insurance Department Regulation No. 96 implementing Section 336-a of the Insurance Law, was promulgated on April 16, 1982, to become effective upon filing with the Department of State. The regulation designates the Property Insurance Loss Register (PILR), 85 John Street, New York, N. Y. 10038, as the central organization to receive reports of fire losses in excess of $ 500.00 from all insurers licensed to underwrite fire insurance in New York State.
The regulation requires all licensed fire insurers to become subscribers of PILR and to submit reports on standard reporting forms with respect to all fire loss claims made on and after January 1, 1982 arising under policies providing coverage against the peril of fire on real and personal property located in this State.
The regulations establishes verification procedures for insurers to follow should a PILR report disclose duplicate undisclosed fire insurance coverage or a record of prior fire loss claims. Insurers are also required to cooperate with law enforcement agencies, investigative insurance organizations engaged in loss prevention, tax districts acting pursuant to the provisions of Section 22 of the General Municipal Law with respect to liens for unpaid property taxes, and with appropriate governmental agencies responsible for demolition of structures, by releasing loss information to assist such agencies in their respective investigations.
All insurers who are not subscribers to PILR are required to become subscribers in order to comply with the provisions of the new regulation. A copy of the regulation is attached.
Companies are directed to have an executive officer acknowledge receipt of this letter within sixty days of the date hereof and to submit documentary evidence establishing the company's subscription to PILR.
