The Office of General Counsel issued the following opinion on February 14, 2007, representing the position of the New York State Insurance Department.

Re: Opinion Requests

Question Presented:

Does the Department require an inquirer to use a specific form or follow a specific procedure when submitting a question that pertains to the New York Insurance Law?

Conclusion:

When an attorney submits a question to the Department regarding the New York Insurance Law, the attorney should set forth his or her questions, preliminary conclusions, a statement of relevant facts and an analysis of the relevant statutes, regulations and case law. The Department then will issue in due course an opinion setting forth this office's conclusions and its analysis of the issues presented.
